THANE: Majlish-e-Mushavreen Majjid Trust will appeal in the higher court against the decision of the Kalyan civil court that ruled in favour of the state in the legal battle over the ownership of the Durgadi temple and Idgah (prayer space) situated on Durgadi Fort.
Chairman of the trust, Sarfuddin Karte, said the court ruled against them only because it failed to file the lawsuit within the three-year window after alleged dispossession, as required by the Limitation Act.
The suit was subsequently deemed barred by limitations, leading to its dismissal, he said. Karte said that during the hearing of this case, which went on for years, trust people were not called to submit any proof or evidence.
This is the reason why they are not happy with this decision and will file an appeal to the higher court against it. The legal battle began in 1976 when the trust filed the suit.
The court rejected the petition made by the Muslim community and declared it as the land of the Thane Collector (Govt of Maharashtra).
