NEW DELHI: BJP on Friday dismissed Congress’ angry protests over I-T action against it saying that the opposition party is trying to distract attention from its failure to obey the laws which apply to political parties as well as all tax payers and is trying to obfuscate the fact that the latest notice of income tax department follows an order of Delhi HC.
At a press conference, BJP spokesperson Syed Zafar Islam emphasised that Congress failed to follow the correct procedures for filing taxes or making appeals even as the party had misrepresented its income.
“From commissioner of I-T to income tax appellate tribunal and even Delhi HC, have upheld actions of income tax department while dismissing Congress’ arguments,” Islam said, adding that instead of engaging in media rhetoric, Congress should adhere to legal processes and fulfil their tax obligations.
Islam said for any registered political party, it is mandatory under Income Tax Act 13 (A) to file their income tax return every year. However, Indian National Congress violated the condition and not only delayed the return but also misrepresented the income. Islam said in such a situation, I-T department was compelled to take action under the law.
“Rahul Gandhi, Mallikarjun Kharge, and other Congress netas who are making statements in the media are running away from the reality,” the BJP functionary said. He said Congress has a history of scams and corruption and the party concealed income and committed tax theft. Zafar Islam underscored that under PM Narendra Modi’s leadership there is a rule of law in country and no one is above the law.
“However, one certain family of Congress party feels that they should get exemptions in everything and there should be separate laws for them, which is not possible in this country anymore,” he added.
He said I-T department found unaccounted cash transactions and unfiled tax returns by Congress during its investigation, based on seized documents.
BJP said accusations levelled by Congress leaders against I-T department and court reveal their frustration. “If satisfactory explanations are not provided, necessary actions will follow,” he added.
Earlier in the day, BJP said Congress thinks that it is above the Constitution and law of the country. “Congress thinks it can become a tax defaulter, lie and play victim. Common people have to pay taxes but Congress keeps itself in a special VVIP category. While opposing PM Modi and BJP, today Congress has started attacking institutions of the country too,” said BJP spokesperson Shehzad Poonawalla.
He said this showed frustration levels of Congress. “Rs 350 crore was found on premises of their MP Dhiraj Sahu. Their 50 MPs will collectively have a lot of money. It is not the lack of money, Congress party lacks candidates and intentions,” he said.
